Terms of Service

These Terms of Service (“Terms”) govern your access to and use of SpokeslyAI (the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

SpokeslyAI lets you generate AI short videos from a script you provide, an optional reference video, and an optional voice cloned from an audio sample you supply. Outputs are generated by automated models and may contain inaccuracies or artifacts.

2. Eligibility & accounts

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. You are responsible for your account credentials and for all activity that occurs under your account. Keep your password secure and notify us promptly of any unauthorized use.

3. Your content & the rights you grant

You retain ownership of the scripts, videos, images, and audio you upload (“Your Content”) and of the videos you generate. You grant us a limited license to store, process, and transmit Your Content solely to operate and provide the Service.

You represent and warrant that you own or have all necessary rights, consents, and permissions to upload Your Content and to create a voice or likeness from it — including the rights to any person’s voice, face, or likeness that appears in your uploads. You are solely responsible for Your Content and the videos you generate. You are responsible for ensuring you have the right to use any reference content you submit to the Service.

4. Acceptable use

You agree not to use the Service to create or distribute content that:

• impersonates a real person without their explicit consent, or that is intended to deceive (including misleading “deepfakes”);
• is unlawful, defamatory, harassing, hateful, or that infringes another’s intellectual property, privacy, or publicity rights;
• is sexual content involving minors, or non-consensual intimate imagery;
• promotes violence, self-harm, or illegal goods; or
• violates any applicable law or third-party platform rules where you publish it.

We may apply automated and manual moderation, and may remove content or suspend accounts that violate these Terms. To report content or behavior that violates these Terms, email support@spokeslyai.com. In the app you can also use Profile → Report a problem.

5. Credits, billing & renewals

The Service runs on credits. Credits may be granted through a subscription (which renews automatically each billing period until you cancel) or purchased as a one-time pack. Generating videos and certain other actions consume credits. Subscription credits are valid for the billing period and expire at its end; purchased credits do not expire. Payments are processed by Stripe; by purchasing you also agree to Stripe’s terms.

6. No refunds

Except where required by law, all charges are final and credits are non-refundable, non-transferable, and not redeemable for cash. You can cancel a subscription at any time to stop future renewals; your remaining subscription credits stay available until the end of the current period. If a generation fails for a technical reason on our side, the credits for that action are returned to your balance.

7. Intellectual property

The Service, including its software, model integrations, and branding, is owned by SpokeslyAI and its licensors and is protected by intellectual-property laws. These Terms grant you no rights in our marks or software beyond the right to use the Service.

8. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that outputs will be accurate, error-free, or suitable for any particular use.

9. Limitation of liability

To the maximum extent permitted by law, SpokeslyAI will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months before the claim.

10. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms or to protect the Service or other users. Sections that by their nature should survive termination will survive.

11. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the “Last updated” date above and, where appropriate, notify you. Your continued use of the Service after changes take effect constitutes acceptance.
