This Privacy Policy explains how SpokeslyAI (“we”, “us”) collects, uses, and shares information when you use the Service. By using the Service, you agree to this Policy. The Service creates AI-generated talking-head videos, which means we process content you provide — including your face and voice — and share it with the third-party AI services described in Section 3. We ask for your permission in the app before any such content is shared.
1. Information we collect
• Account data — your email address and authentication details when you sign up (including via Google or Apple sign-in).
• Content you provide — scripts and topic text, reference videos, photos, and voice/audio samples you record or upload, and the videos you generate.
• Face and likeness data — when you record or upload a video or photo of yourself to create an avatar, that recording contains your face. We treat it as described in Section 4.
• Voice data — when you record or upload a voice sample to clone your voice, we collect that audio.
• Billing data — subscription and purchase records. On the web, card details are collected and processed by Stripe; in the iOS app, purchases are processed by Apple. We do not store your full card number.
• Usage data — basic logs and diagnostics needed to operate, secure, and improve the Service.
2. How we use your information
We use your information to provide and operate the Service (including generating your videos from the content you provide), to process payments and manage credits, to provide support, to maintain security and prevent abuse, and to comply with legal obligations. We do not sell your personal information, and we do not use your face or voice for advertising, for identifying you, or to build a biometric profile of you.
3. Third-party AI services and other service providers
To generate your videos we send the content you provide to third-party AI services that process it on our behalf, under contract, only to provide the Service. By contract these providers are required to protect your data with safeguards comparable to those in this Policy and to use it only to perform the service for us. The third-party AI services are:
• HeyGen — when you choose an “AI avatar”, we send your script and, depending on your choices, your uploaded photo or video and your cloned voice, so HeyGen can generate the avatar video.
• OpenAI — we send your script or topic text to write or improve your script, and reference audio to transcribe it into text. OpenAI does not use this content to train its models when accessed through its API.
We also use the following infrastructure providers, which process data on our behalf to operate the Service:
• Supabase — authentication, database, and file storage for your recordings and generated videos.
• Cloudflare — application hosting, content delivery, and object storage.
• Cloud GPU infrastructure (Modal) — running our own AI models that clone your voice and generate your talking-head videos.
• Stripe — payment processing (web).
• Resend — sending transactional emails such as confirmations and password resets.
4. Face and voice data
What we collect. When you record or upload a video or photo to create an avatar, we collect that image/video, which shows your face. When you record or upload a voice sample, we collect that audio.
How we use it. We use your face and voice data for one purpose: to generate the AI talking-head video you ask us to create — lip-syncing an avatar and synthesizing your cloned voice. We do not use it for facial recognition or identity verification, we do not create a biometric template to identify you, and we do not use it for advertising.
Who we share it with. Your face and voice data are processed by our own AI models on our cloud GPU infrastructure (Modal) and, when you choose an AI avatar, are shared with HeyGen (Section 3) to generate the video. They are stored on our infrastructure providers (Supabase and Cloudflare). We do not share your face or voice data with any other third parties, and we do not sell it.
Where it is stored and how long we keep it. Uploads are stored on our infrastructure providers (Supabase and Cloudflare). The input recordings and photos you upload (reference videos, voice samples, avatar photos) are automatically deleted after approximately 30 days, and generated output videos after approximately 14 days. You can also delete your account at any time from the app (Profile → Delete account), which removes your account and associated content.
Consent. Before we share your recordings, photos, or scripts with the third-party AI services above, we disclose this in the app and ask you to agree. You should only upload your own face and voice, or those of a person who has given you permission.
5. Data retention
Generated output videos are retained for approximately 14 days and the inputs you upload (reference videos, photos, voice samples) for approximately 30 days, after which they are automatically deleted from storage. Account and billing records are kept as long as needed to provide the Service and to meet legal and accounting requirements. You may request deletion of your account and associated data, or delete your account directly in the app (see Contact).
6. Your rights
Depending on where you live, you may have the right to access, correct, export, or delete your personal information, and to object to or restrict certain processing. To exercise these rights, contact us using the details below or delete your account in the app.
7. Security
We use reasonable technical and organizational measures to protect your information. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
8. Children
The Service is not directed to children under 18, and we do not knowingly collect personal information from them.
9. Changes to this Policy
We may update this Policy from time to time. We will update the “Last updated” date above when we do, and where appropriate provide additional notice.
